5. Marketing communications

We will only send you marketing messages where you have consented or where the law otherwise allows. Every marketing email includes an unsubscribe link, and you can opt out at any time by using it or contacting us. Opting out of marketing does not stop us replying to messages you send us.

We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, change or disclosure, including access controls, encryption in transit and confidentiality obligations. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

We keep personal information only for as long as we need it for the purposes in this policy, or as required by law. After that, we take reasonable steps to securely delete or de-identify it.

Last updated: 23 September 2026

1. About these Terms

These Terms of Use ("Terms") apply to your use of the Rich Planet website at www.richplanet.earth, and to our shows, field guides, newsletters, social media channels and other content (together, our "Services").

The Services are provided by Rich Planet (ABN 65 695 916 904) ("Rich Planet", "we", "us", "our").

By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

These Terms should be read together with our Privacy Policy, which explains how we collect and handle personal information. If there is any inconsistency, the Privacy Policy applies to personal information and these Terms apply to everything else.

2. Changes to these Terms

Our Services will change over time, and we may update these Terms when they do. The current version will always be available on our website with the "Last updated" date above. Where changes are significant, we will try to let you know through our website or by email. By continuing to use our Services after changes take effect, you accept the updated Terms.

3. Using our Services

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use our Services for your own personal, non-commercial purposes, in line with these Terms.

You must not:

4. Our content

All Intellectual Property Rights in our Services, including our shows, videos, field guides, articles, images, graphics, logos, branding and website design, belong to Rich Planet or our licensors. "Intellectual Property Rights" means copyright, trade marks, designs, know-how and any other intellectual or industrial property rights anywhere in the world, whether or not registered.

You may view, and share links to, our content for personal, non-commercial purposes. You must not copy, reproduce, edit, republish, distribute, sell or otherwise use our content for any other purpose without our prior written permission. To ask about using our content, contact us using the details in section 14.

5. General information only

Our shows, field guides and other content share stories, research and general information about regeneration and the people doing it. We work hard to check our claims, but our content is general in nature and does not take your circumstances into account.

It is not a substitute for independent professional advice, including agronomic, environmental, financial, legal, tax or investment advice. You are responsible for deciding whether and how to act on anything you see or read from us. Views expressed by guests, contributors and partners in our content are their own.

6. Things you send us

When you send us information, ideas or other material, including through our forms, by email or through our social media channels, you confirm that you are entitled to share it and that it is accurate.

Unless we agree otherwise in writing, we are not obliged to keep ideas or suggestions you send us confidential, and we may use them to develop our Services without owing you anything. We will always handle your personal information in line with our Privacy Policy.

If you share the personal information of another person with us, you confirm that you are authorised to do so and that they know how it will be handled under our Privacy Policy.

7. Partnerships

Submitting a partnership enquiry does not create any agreement between you and us. Any partnership, co-production, sponsorship or collaboration will be governed by a separate written agreement, which will take precedence over these Terms for that arrangement.

8. Third-party links and platforms

Our Services link to and may display content from third-party websites and platforms, such as Instagram, YouTube, TikTok, LinkedIn, Spotify and Apple Podcasts, as well as the websites of our partners. We do not control these, and we are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms and policies.

9. Availability

We aim to keep our website available and up to date, but we do not guarantee that our Services will be uninterrupted, error-free, secure or free of viruses. We may change, suspend or discontinue any part of our Services at any time without notice.

10. Your consumer rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for a breach of a consumer guarantee, our liability is limited to supplying the relevant services again or paying the cost of having them supplied again.

11. Limitation of liability

Subject to section 10, and to the maximum extent permitted by law:

12. Indemnity

You indemnify us against all claims, costs, damages and losses arising from your breach of these Terms or your misuse of our Services, except to the extent caused by our own negligence or breach.

13. General

If any part of these Terms is found to be invalid or unenforceable, it will be read down or severed to the extent necessary, and the rest of these Terms will continue to apply.

If we do not enforce any part of these Terms, that is not a waiver of our rights. Any waiver must be in writing.

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them.
